1. Scope

These Terms & Conditions (“Terms”) apply to all purchases and use of digital and physical products offered
on www.arkaia-experience.com. By accessing or purchasing from our website, you agree to these Terms.

“Arkaia” is the brand name under which products are offered.

3. Products

We offer:

Digital products (audio downloads, video content, PDF guides, memberships)
Physical products (handmade natural products, incense, clothing, merchandise)

No therapeutic, medical, or healing services are offered.

Product descriptions, availability, and prices may change at any time.

4. Prices, VAT & Payment

All prices are stated in EUR and include VAT where applicable.

For customers within the European Union, VAT may be charged according to applicable EU VAT rules depending on the customer’s location and the nature of the product.

Payments are processed securely via Wix Payments, Stripe, or PayPal. The full purchase price is due immediately upon order confirmation.

5. Delivery & Access

Digital products:
Digital products are provided via download and/or access on the website (e.g., customer account) immediately after successful payment, unless otherwise stated on the product page.

Physical products:
Shipping costs, delivery times, and available shipping regions are stated at checkout and/or on the product page. If a delivery is delayed due to factors beyond our control, we will inform you as soon as possible.

6. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the statutory right to withdraw from a purchase within 14 days without giving reasons.

Physical products:
The withdrawal period is 14 days from the day you (or a third party nominated by you) receive the goods. Returned items must be unused, undamaged, and (where possible) in original packaging. The buyer bears the cost of return shipping. Refunds are issued after inspection of the returned goods.

Digital products (downloads / streaming / access):
For digital content not supplied on a tangible medium, your right of withdrawal expires once performance has begun, provided that:

you have expressly consented to immediate supply/performance, and
you have acknowledged that you thereby lose your right of withdrawal.

By purchasing a digital product and selecting immediate access/download (where offered), you consent to immediate performance and acknowledge the loss of your withdrawal right.

7. Memberships / Subscriptions

If a product is offered as a subscription, cancellation terms (monthly/annual) are stated on the product page and/or at checkout.

Unless otherwise stated, subscriptions can be cancelled for future periods. No partial refunds are granted for already started billing periods.

8. Intellectual Property & License

All content (including audio, video, texts, images, and designs) is protected by intellectual property laws and remains the property of Sebastian Schmuck / Arkaia.

Upon purchase, you receive a non-exclusive, non-transferable license for personal use only, unless otherwise stated on the product page. You may not copy, distribute, publicly perform, resell, share, or make the content available to third parties without prior written permission.

9. Retention of Title (Physical Products)

Physical goods remain our property until full payment has been received.

10. Liability

We are liable without limitation for intent and gross negligence.

For slight negligence, we are liable only in cases of breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract.

Liability for injury to life, body, or health remains unaffected.

11. Governing Law & Jurisdiction

These Terms are governed by German law.

If you are a consumer residing in the EU, mandatory consumer protection laws of your country of residence remain unaffected.

For business customers, the place of jurisdiction is Ingolstadt, Germany.
